Steps To Take To Run a UK Tutoring Business Safely

That's part of running a business.
It's to make sure the steps you are taking to run it are safe and under the law.
For example, if you are to cancel a refund for your customer, how do you do that?
You can't just have your own terms for it.
You still have to follow the rules given by the law.
So in today's case study, I share with you how we customized the business terms of a Tutoring Company in the UK.
To make sure, every step they took was under the law and was for the protection of all parties involved.
Our client was running a Tutoring Business in the UK.
The business was doing quite well as they were rapidly growing.
But now they wanted customized terms and conditions for the parents, just so that everyone was on the same page.
That's why they approached us to draft the Tutoring Agreement for the parents to sign.
Problems:
1) Customizable Document:
Our client was providing a lot of different courses and different packages.
And that's why they wanted an easily customizable document.
2) Refund Issues:
They faced certain refund problems.
Basically where the customer will seek their courses and seek refunds thereafter.
3) Marketing Strategy Alignment:
They wanted to make sure their marketing strategy, which offered a success guarantee, was within their ambits.
Solutions:
1) Drafting a Customizable Document
We analyzed different packages and courses that they were offering and accordingly made a master document containing the common terms.
We gave an option to the customer to select the desired package, sign the document, and send it back.
This made their contracting process much more efficient and easier.
2) Tackling the refund problem
UK law provides customers a statutory right to cancel a contract within 14 days of signing and seek a refund.
However, there are certain exceptions, such as where they sign a waiver.
We drafted a separate waiver fulfilling all the conditions in the statute, making it valid and enforceable.
Where the customer won’t sign the waiver, we advised them to keep a buffer and only start the lectures 14 days after signing, so the cancellation period is over.
3) Refund Guarantee
The problem with offering any kind of guarantee is - if it’s too broad it will make the business more vulnerable.
Hence, we drafted a guarantee clause keeping its applicability to a limited extent.
And, provided certain other provisions including data protection to protect their business in contingencies.
Now by taking these steps, we made sure our client had:
1) A Master Document to provide the courses
2) Proper Refund Guidelines to facilitate any refunds within the law
3) Proper Guarantee terms for any of their marketing strategies
This helped them position their business in a much better way.
A lot of new business owners make the mistake of going with whatever they want.
However, the law typically has guidelines in place for the protection of customers.
And you can't break those guidelines, you have to operate within them.
