I’ve seen a lot of Marketing Agencies use this Tactic

If you're running a marketing or SEO agency, here's something you need to know:

Making bold claims on the internet is never a good thing.

Not unless you can back those claims up.

And sadly, I've seen many marketing and SEO agencies that often make exaggerated claims to their clients.

Some even give guarantees that they'll ensure their client's business will take off.

Unsurprisingly, there are plenty of cases where they failed to deliver on such promises.

And then they teach these same practices to other people.

Now here are 2 major mistakes they make:

1) Worst-Case Scenarios

These agencies think that the worst-case scenario where they fail to deliver would be the client opting to terminate their contract.

However, termination is just a remedy for them to escape the contract.

The client has other legal recourses.

For example, they can sue your business for damages too.

Whether they exercise such an option is a different story, though.

But there’s always a risk for you.

2) Disclaimer Won’t Save You

Many agencies have a habit of promising something on call.

And then include a disclaimer in their contract, assuming it will protect them.

But that's not enough.

The client can still sue you for misrepresentation.

And also hold you liable for the promise in your offer.

Their contention would be:

Your agency made bold claims in your offer and thereby induced entry into a contract.

And, that disclaimer in fine print won’t be able to protect you.

Some agencies even use liability caps - to limit their liability in any case.

However, disclaimers, liability caps, and other such terms...

Which puts the client at a disadvantage IF NOT MADE CLEAR, and can be treated as “unfair terms”.

And that makes them unenforceable.

That's it.

A lot of people see others following such practices and think that it's common in the industry.

Well, not everything others are doing is right.

And you don’t know what legal problems they are facing themselves due to their actions.

As a marketing agency, it's your job to nurture and guide your clients to build brands and businesses the right way.

All the while making sure that they don't run into a lawsuit.

And also making sure that the practices you have to attract such clients are also right.
